Local 776 Member Wins $15,000 Grievance

Union Leaders Fight Long Battle


Thanks to the strong representation of Local 776, an 11-year veteran of ABF Freight has won $15,000 in back wages and pension benefits involving a lengthy medical dispute with the company.
“We are dealing with more and more disputes over medical issues involving the companies’ doctors,” said Dan Virtue, President of Local 776 in Harrisburg, Pennsylvania. “We will continue to fight on our members’ behalf.”The case involved a road driver who tried to get his U.S. Department of Transportation (DOT) re-certification last year. After getting the re-certification, the company’s doctor changed his mind, setting in motion a lengthy dispute that required the driver to visit doctors and get tests done on his heart.Local 776 filed a grievance on the driver’s behalf. While the grievance was pending, the driver was forced off the job between late July 2004 and November 2004.The case initially deadlocked, but was decided at the Eastern Region Joint Area Review Committee, which heard the case in late June.Last month, the driver received the $15,000 in back wages and pension benefits.

“The company wrongfully denied him his right to work, but we didn’t give up,” said Keith LaCroix, a Local 776 business agent. “We have two similar cases pending, and we will fight those cases as well until our members receive the justice they deserve.”

 About the IBT Freight Division

The Freight Division represents the interests of more than 80,000 Teamsters members from approximately 238 local unions. Freight employees include truck drivers, dockworkers, mechanics, and office personnel.

The vast majority of freight members work under the terms of the National Master Freight Agreement (NMFA). Together with a team of Teamsters freight leaders selected from across the country, the Freight Division helps negotiate the NMFA as well as supplemental agreements that cover specific geographic areas and/or job classifications. The Division also approves contracts per NMFA standards. In March 2003, freight members ratified the current NMFA, which will be in effect through March 2008.On a daily basis, the Freight Division coordinates National Grievance Panels, Regional Grievance Panels, changes of operations, and negotiations of individual contracts.

The Freight Division also responds to questions from members and local unions concerning worker benefits, equipment safety, grievances, changes of operation, and organizing new members. The Division works closely with other departments to further the interests of freight members.

ABOUT THE IBT PARCEL & SMALL PACKAGE DIVISION

The Teamsters Parcel and Small Package Division serves nearly 200,000 members throughout the United States. United Parcel Service is the single largest employer in the Teamsters Union, and the Division is responsible for ensuring that management abides by the National Master Agreement.

Through outreach on our website and area steward training programs, the Parcel and Small Package Division works to ensure that the security of a good Teamster contract is available to all members.
